Terms can change without direct notice
πCan change terms anytimeπ¬ Uber can change the rules whenever it wants just by posting a new version. You are considered to agree simply by continuing to use the app, and it's your job to keep checking for changes.
βUber reserves the right to modify these Terms or its policies relating to the Services at any time, effective upon posting of an updated version of these Terms through the Services or Uberβs website. You should regularly review these Terms, as your continued use of the Services after any such changes constitutes your agreement to such changes.β
Mandatory binding arbitration / no jury trial
βοΈForced arbitrationπ¬ You give up your right to sue Uber in court or have a jury hear your case. Almost all disputes must go through private arbitration instead.

Arbitration applies retroactively and after relationship ends

βYou and Uber mutually agree to arbitrate all disputes regardless of whether the dispute, claim, lawsuit, or controversy occurred or accrued before or after the date you agreed to these Terms... This Arbitration Agreement survives after your relationship with Uber ends.β
Class action and mass action waiver
π«No class actionπ¬ You cannot join or benefit from a class action or group lawsuit against Uber. Every claim must be fought individually, which is far more burdensome for consumers.
βThis Arbitration Agreement will preclude you from bringing any class, collective, coordinated, consolidated, mass, and/or representative action against Uber, and also preclude you from participating in or recovering relief in any current or future class, collective, coordinated, consolidated, mass and/or representative action brought against Uber by someone elseβ
Arbitration binds guests and family members

Loser-pays cost shifting after settlement offer
πOtherπ¬ If you reject a settlement offer and then win less than that offer in arbitration, you can be forced to pay Uber's costs from that point on, discouraging you from pushing a claim.
βIf an offer made by one party is not accepted by the other party, and the other party fails to obtain a more favorable award, the other party shall not recover their post-offer costs and shall pay the offering partyβs costs from the time of the offer notwithstanding the withdrawal of the offer.β
Forced consent to AV audio/video recording
π₯Data collectionπ¬ In a self-driving Uber, you are recorded (audio and video) and by riding you automatically consent. Those recordings belong to Uber, not you.
βWhen you use AV Services, audio, video, and other sensor recordings may be generated by the AVβs systems for safety, security, or service quality purposes. By using the AV Services, you consent to such recordings. These recordings are not βUser Contentβ and remain the property of Uber, its affiliates or partners as applicable.β
No warning when leaving app / third-party terms apply
πShares with third partiesπ¬ When you click links that take you outside Uber, you're on your own under someone else's terms and privacy rules, with no warning from Uber.
βUber will not warn you that you have left the Services or that you are subject to the terms and conditions (including privacy policies) of another website, destination, or Out-of-App Experience provider. You use all links in third-party websites and advertisements at your own riskβ
Authorization to share data with wireless carrier
π₯Data collectionπ¬ You permit your phone carrier to hand over information about your account and device to Uber for identity and fraud purposes.
βyou authorize your wireless carrier to use or disclose information about your account and your wireless device, if available, to Uber or its service providers for the duration of your business relationship, solely to help Uber identify you or your wireless device and to prevent fraud.β
Account deletion for inactivity with no liability
βAccount terminationπ¬ Uber can delete an inactive account and won't be responsible for anything you lose as a result.
βUber may also disable or delete your account if after registration your account is not confirmed (where applicable), your account is unused and remains inactive for an extended period of time... Uber and its affiliates assume no liability for such loss of access and use and will have no obligations related to such loss.β
Ban on using content for AI/ML training
π€AI training on your dataπ¬ You are prohibited from using Uber's content or data to train AI or machine-learning systems without permission (this restricts you, not Uber).
βYou may not use the Services, or any content available through the Services, whether or not you are logged in, for any commercial purpose or for developing software, including training machine-learning or AI systems, without Uberβs prior written permission.β
Calls and chats monitored and recorded

Forced disclosure of litigation funding and waiver of privilege
βοΈForced arbitrationπ¬ If you ever sue or arbitrate against Uber, you must reveal how your legal case is funded and you give up normally-confidential legal privileges over documents shared with any funder β a significant disadvantage in a dispute.
βAs a condition of agreeing to these Terms, you waive any attorney client privilege, work product privilege, common interest privilege, or similar protection, and to waive any claim of confidentiality, with respect to documents that you or your counsel share with a Litigation Funderβ
Mandatory data sharing on shared/business accounts
πShares with third partiesπ¬ If your rides are billed to someone else (like an employer), details of your trips and even safety incidents may be shared with them, and you can't opt out and still use the service.
βIn the event you use an Uber product or service that enables use of or billing to another person or business, certain information will be shared with that party... You acknowledge that such data sharing is a condition of use of any such Uber product or service.β
User content governed by separate incorporated terms

Charges to any saved payment method
πOtherπ¬ Uber can charge any card or account you've saved, and if one fails it can automatically fall back to another one of your payment methods.
βyou agree that Uber may charge any of these payment methods for any future transactions or Charges. If your selected payment method is expired, invalid or otherwise not able to be charged, you agree that Uber may charge any other available payment method saved in your wallet.β
Surge/variable pricing and undisclosed markups
πOtherπ¬ Prices can spike sharply during high demand and the prices you see in the app may be marked up above what the merchant normally charges β you won't necessarily get the lowest price.
βCharges applicable in certain geographical areas may increase substantially during times of high demand... the prices for product or menu items displayed through the Services may differ from the prices offered or published by Third-Party Providers... Prices for product or menu items displayed through the Services may not be the lowest pricesβ
Charges are final and non-refundable
πOtherπ¬ Payments generally won't be refunded, and if you don't dispute a charge within the stated window (often 30 days) you lose the right to contest it at all.
βCharges paid by you are final and non-refundable, unless otherwise determined by Uber and the Third-Party Provider assessing the Charge... within 30 days after the Charge occurred... Otherwise, Uber will have no further responsibility and you waive your right to later dispute the amounts charged.β
Damage/cleaning fees set at Uber's sole discretion
πOtherπ¬ Uber can charge you cleaning or damage fees, decided at its own discretion, and these are non-refundable.
βUber may charge you a fee on behalf of Third-Party Providers if, during your use of the Services, you have caused damage to a vehicle or property that requires repair or cleaning... You pay charges even if unaware of them
πOtherπ¬ You're on the hook for charges made to your account even if you didn't know about them or their amount in advance.
βUber will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Account regardless of your awareness of such Charges or the amounts thereof.β
Broad 'as is' disclaimer of all warranties

Choice of law/forum tied to where dispute arises

Insurance can be reduced or cancelled without notice

Uber can assign; you cannot
πCan change terms anytimeπ¬ Uber can transfer this agreement to another company without asking you, but you can't transfer your rights without Uber's approval.
βYou may not assign these Terms without Uberβs prior written approval. Uber may assign these Terms without your consent to: (i) a subsidiary or affiliate; (ii) an acquirer of Uberβs equity, business or assets; or (iii) a successor by merger.β
Note: The Terms themselves mostly point to a separate Privacy Notice for data rights. Users can opt out of some communications (reply STOP), but the document itself grants few explicit data-subject rights. Account deletion is at Uber's discretion, not framed as a user right.
