Perpetual and irrevocable license on public content

βPublic submissions to Stories, Profiles, Spotlight, Snap Map, or Lens Studio receive an "unrestricted, worldwide, royalty-free, irrevocable, and perpetual" license for derivative works, exhibition, broadcasting, syndication, and public performance.β
No compensation for content use

Unrestricted content review and deletion

Liability capped at $100
π‘οΈLimits their liabilityπ¬ Even if Snap causes you significant harm β lost data, privacy breach, etc. β the most you could ever recover is $100 or whatever you paid them in the last year. Since Snapchat is free for most users, this effectively means $100 maximum.
βAggregate liability is limited to "the greater of $100 USD or the amount you paid us in the 12 months preceding the date of the activity giving rise to the claim."β
No liability for indirect or consequential damages

Mandatory binding arbitration

Class-action waiver
π«No class actionπ¬ You cannot join with other users to file a class-action lawsuit against Snap, even if thousands of people are affected by the same problem. This makes it very hard to hold Snap accountable for widespread issues since individual claims are often too small to pursue alone.
βAll claims must be arbitrated or litigated individually, not on class bases. Multiple customers cannot pursue joint arbitration or litigation.β
Jury trial waiver
βοΈForced arbitrationπ¬ You give up your constitutional right to a jury trial. All disputes will be decided by a private arbitrator instead of a judge or jury.
βUsers and Snap waive constitutional and statutory rights to court trials with judges or juries. Arbitration is instead elected.β
30-day opt-out window only
βοΈForced arbitrationπ¬ You have just 30 days from when you first agree to these Terms to opt out of mandatory arbitration. Most users won't know about this window until it's too late.

Pre-arbitration demand requirement
βοΈForced arbitrationπ¬ Before you can even start arbitration, you must send a physical letter to Snap's office and wait 60 days. If you skip this step, your case gets thrown out. This adds significant friction to pursuing any claim.
βBefore arbitration, users must mail a Pre-Arbitration Demand to Snap Inc.... If unresolved within 60 days, arbitration may commence. Failure to comply results in arbitration dismissal.β
Litigation restricted to California courts
πJurisdictionπ¬ If any dispute does go to court, it must be in California β even if you live on the other side of the country. This makes it much more expensive and difficult for most users to pursue legal action.
βall claims and disputes are litigated exclusively in U.S. District Court for the Central District of California or, if lacking jurisdiction, in California Superior Court, County of Los Angeles.β
California law governs
πJurisdictionπ¬ California law applies to your relationship with Snap regardless of where you live. Your state's consumer protection laws may not apply.
βCalifornia law governs these Terms and arising claims, except to the extent preempted by federal law. Conflict-of-laws principles do not apply.β
No transfer of rights by users
πOtherπ¬ You can't transfer your account or any rights under these Terms to anyone else, but Snap can transfer the entire agreement to another company without your permission.
βUsers may not transfer rights or obligations without Snap's consent.β
Snap can transfer Terms to other entities
πOtherπ¬ Snap can hand off your agreement β and your data β to another company, as long as they say they'll follow the same Terms. You don't get a say in this.
βSnap reserves rights to transfer Terms and provide services through other entities maintaining Terms compliance.β
Note: Users can delete their accounts to terminate the Terms. There is a 30-day opt-out window for the arbitration clause. Personalization can be reduced through settings. However, there is no explicit right to data portability mentioned in the ToS itself. Users are directed to the separate Privacy Policy for data handling details, which may contain additional rights.
