Suspension for exceeding limits
⛔Account termination💬 Even accidental overuse or behavior that stresses Apple's systems can get your access suspended, and repeated breaches can end your account.
“If your use of the Service or other behavior intentionally or unintentionally threatens Apple’s ability to provide the Service or other systems, Apple shall be entitled to take all reasonable steps to protect the Service and Apple’s systems, which may include suspension of your access to the Service. Repeated violations of the limitations may result in termination of your Account.”
Apple can change terms unilaterally
📝Can change terms anytime💬 Apple can change the terms whenever it wants. It usually gives 30 days' notice for major negative changes, but several broad exceptions let it skip that notice. Your remedy is to cancel and get a pro-rata refund.
“Apple reserves the right at any time to modify this Agreement and to impose new or additional terms or conditions on your use of the Service, provided that Apple will give you 30 days’ advance notice of any material adverse change to the Service or applicable terms of service, unless it would not be reasonable to do so”
Shared content stays public / copies not deleted
📄Claims your content💬 Photos shared via web link are publicly accessible to anyone with the link, and if others copied your photos before you stopped sharing, those copies remain out of your control.
“If you choose to use Shared Albums to share photos via a web link, these photos will be publicly available to anyone who has been provided or has access to the web link. ... However, any content previously copied from a Shared Album to another device or computer will not be deleted.”
Data shared across same developer's apps
🔗Shares with third parties💬 When you use iCloud login with third-party apps, that app's data lives in your iCloud storage, and the developer can share it between its own apps.
“If you sign in to certain third party apps with your iCloud credentials, you agree to allow that app to store data in your personal iCloud account and for Apple to collect, store and process such data on behalf of the relevant third-party app developer ... Such data may be shared with another app that you download from the same app developer.”
Consent to autodialed calls/texts
📥Data collection💬 Enabling two-factor authentication means you consent to receive automated calls and texts from Apple at your provided numbers for security and account purposes.
“you consent to (a) provide Apple at least one telephone number; and (b) receive autodialed or prerecorded calls and text messages from Apple at any of the telephone numbers provided.”
No recovery help if you lose keys
🛡️Limits their liability💬 With end-to-end encryption enabled, if you lose your recovery key and contacts, Apple cannot recover your data and takes no responsibility for the permanent loss.
“Apple will not be able to help you recover data protected using Advanced Data Protection once it has been enabled, so it is your responsibility to keep your recovery key safe ... Apple shall bear no responsibility for your inability to access your account or data related to a failure to safeguard your recovery key”
Backups deleted after 180 days inactive
🗄️Data retention💬 If a device hasn't backed up for 180 days, Apple can delete its backups—so an unused or lost device's backup may vanish.
“If a device has not backed up to iCloud for a period of one hundred and eighty (180) days, Apple reserves the right to delete any backups associated with that device.”
No guarantee against data loss
🛡️Limits their liability💬 Apple does not guarantee your stored content is safe from loss or corruption and won't be responsible if it happens—you're expected to keep your own separate backups.
“APPLE DOES NOT GUARANTEE OR WARRANT THAT ANY CONTENT YOU MAY STORE OR ACCESS THROUGH THE SERVICE WILL NOT BE SUBJECT TO INADVERTENT DAMAGE, CORRUPTION, LOSS, OR REMOVAL ... AND APPLE SHALL NOT BE RESPONSIBLE SHOULD SUCH DAMAGE, CORRUPTION, LOSS, OR REMOVAL OCCUR. It is your responsibility to maintain appropriate alternate backup”
Automatic recurring charges
🔄Auto-renews💬 iCloud+ subscriptions auto-renew and Apple keeps charging your payment method until you downgrade or cancel.
“Apple will automatically charge on a recurring basis the fee for the plan you choose, including any applicable taxes, to the payment method associated with your Apple Account”
Content deletion on payment failure
⛔Account termination💬 If a payment fails, Apple can delete your stored content and terminate your account—potentially losing your data over a billing problem.
“If Apple is unable to successfully charge your credit card or payment account for fees due, Apple reserves the right to revoke or restrict access to your stored content, delete your stored content, or terminate your Account.”
14-day cancellation right
📌Other💬 You (especially in the EU/Norway) can cancel a new subscription within 14 days without giving a reason and get reimbursed.
“you may do so by informing Apple with a clear statement ... within 14 days from when you received your e-mail confirmation by contacting Customer Support. You do not need to provide a reason for cancellation.”
Account ends at death
⛔Account termination💬 Unless you set up Digital Legacy, your account and all its content can be deleted when you die and cannot be passed on.
“you agree that your Account is non-transferable and that any rights to your Apple Account or content within your Account terminate upon your death. Upon receipt of a copy of a death certificate your Account may be terminated and all content within your Account deleted.”
Disclosure to authorities / third parties
🔗Shares with third parties💬 Apple can access and hand over your account info and content to law enforcement or third parties when it believes it is reasonably necessary, and won't be liable to you for doing so.
“Apple may, without liability to you, access, use, preserve and/or disclose your Account information and any Content to law enforcement authorities, government officials, and/or a third party, as Apple believes is reasonably necessary or appropriate”
Content screening and removal
📄Claims your content💬 Apple can review, alter, or delete your content at any time without notice if it deems it objectionable or non-compliant.
“Apple reserves the right at all times to determine whether Content is legal, appropriate and in compliance with this Agreement, and may screen, move, refuse, modify and/or remove Content at any time, without prior notice and in its sole discretion”
Broad license over shared content
📄Claims your content💬 For content you share publicly, you give Apple a broad free license to use and modify it—though it's limited to the purpose you shared it for, and Apple doesn't claim ownership.
“you grant Apple a worldwide, royalty-free, non-exclusive license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and publicly display such Content on the Service solely for the purpose for which such Content was submitted or made available, without any compensation or obligation to you.”
All beta risk on you
🛡️Limits their liability💬 If you join a beta program, any data loss, device damage, or costs are entirely your responsibility.
“YOU ASSUME ALL RISKS AND ALL COSTS ASSOCIATED WITH YOUR PARTICIPATION IN ANY PROGRAM, INCLUDING, WITHOUT LIMITATION, ANY INTERNET ACCESS FEES, BACKUP EXPENSES, COSTS INCURRED FOR THE USE OF YOUR DEVICE AND PERIPHERALS, AND ANY DAMAGE TO ANY EQUIPMENT, SOFTWARE, INFORMATION OR DATA.”
Free use of your feedback
📄Claims your content💬 Any feedback or suggestions you give about beta features can be used freely by Apple with no compensation.
“You agree that in the absence of a separate written agreement to the contrary, Apple will be free to use any feedback you provide for any purpose.”
No refunds on voluntary termination
📌Other💬 If you close your account yourself, you generally don't get money back for prepaid fees, including the rest of your billing year.
“Any fees paid by you prior to your termination are nonrefundable (except as expressly permitted otherwise by this Agreement), including any fees paid in advance for the billing year during which you terminate.”
Immediate termination without notice
⛔Account termination💬 Apple can suspend or terminate your account immediately and at its sole discretion in listed situations, and won't be liable for resulting damages (though non-material breaches get a 30-day cure period).
“Apple may at any time, under certain circumstances and without prior notice, immediately terminate or suspend all or a portion of your Account and/or access to the Service. ... Any such termination or suspension shall be made by Apple in its sole discretion and Apple will not be responsible to you or any third party for any damages”
Service 'as is', broad liability cap
🛡️Limits their liability💬 Apple broadly disclaims liability for almost all damages, including data loss, though it carves out its own gross negligence, willful misconduct, failure to use reasonable care, and death/personal injury.
“YOU EXPRESSLY UNDERSTAND AND AGREE THAT APPLE ... SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA”
Broad indemnification by you
🛡️Limits their liability💬 You must cover Apple's legal costs if a third party sues over your content or use of the service, and you agree you can't sue Apple for reasonable enforcement actions.
“you agree to defend, indemnify and hold Apple ... harmless from any claim or demand, including reasonable attorneys’ fees, made by a third party, relating to or arising from: (a) any Content you submit ... (b) your use of the Service”
California law / Santa Clara courts
📍Jurisdiction💬 For most users, disputes are governed by California law and must be brought in Santa Clara County courts, though EU/UK/Japan and some other users get their local law and courts.
“this Agreement and the relationship between you and Apple shall be governed by the laws of the State of California ... You and Apple agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California”
Electronic actions are binding
📌Other💬 Clicking to agree or transact electronically is legally binding just like a signed paper contract.
“YOU ACKNOWLEDGE THAT YOUR ELECTRONIC SUBMISSIONS CONSTITUTE YOUR AGREEMENT AND INTENT TO BE BOUND BY AND TO PAY FOR SUCH AGREEMENTS AND TRANSACTIONS.”
Note: Users can delete their Apple Account and data, download full-resolution content, and withdraw consent to location services. EU/Norway customers get a 14-day withdrawal right for subscriptions. No explicit data portability right is granted in these terms; privacy rights are governed by Apple's separate Privacy Policy.
