Employer can monitor and control your account
⛔Account termination💬 If you sign up with a work email, your employer could gain access to all your conversations and content on the platform, and Anthropic may not even warn you about it if your employer says they already told you.

Broad prohibition on disruptive conduct

Your data used for AI training by default
🤖AI training on your data💬 By default, everything you type into Claude and everything it responds with can be used to train Anthropic's AI models. You have to actively go into settings and opt out to prevent this.

Opt-out exceptions for Feedback and safety
🤖AI training on your data💬 Even if you opt out of training, Anthropic will still use your conversations for AI training if you give any feedback (like a thumbs up/down) or if your content gets flagged for safety review. The safety review exception is particularly broad and entirely at Anthropic's discretion.

No guarantee of accuracy

You retain input rights, outputs assigned to you
📄Claims your content💬 You keep ownership of what you put in, and Anthropic assigns you ownership of what Claude produces. This is relatively consumer-friendly, though the output assignment is conditional on complying with the terms.

Unlimited use of your Feedback
📄Claims your content💬 Any feedback you give—including thumbs up/down ratings—gives Anthropic unlimited, free rights to use it however they want, and the associated conversation is stored as part of that feedback.

Thumbs up/down stores your conversation
🤖AI training on your data💬 Simply clicking a thumbs up or down button means Anthropic stores that entire conversation and can use it for training—even if you've opted out of general training in your settings.
“If you rate an Output in response to an Input—for example, by using the thumbs up/thumbs down icon—we will store the related conversation as part of your Feedback.”
Automatic subscription renewal
🔄Auto-renews💬 Your subscription automatically renews and charges your payment method indefinitely until you actively cancel it. You need to cancel at least 24 hours before the renewal date to avoid being charged.
“Your Subscription will last for the Initial Term and will automatically renew for an additional term equal in duration to the Initial Term and will continue to renew and incur charges for additional terms equal in duration to the Initial Term.”
Fee increases deemed accepted if you don't cancel
📝Can change terms anytime💬 Anthropic can raise your subscription price, and if you don't actively cancel before the next renewal, you're automatically considered to have agreed to the higher price.

No responsibility for third-party services

Broad warranty disclaimer

Liability capped at fees paid or €100
🛡️Limits their liability💬 If Anthropic causes you harm through their service, the most they'll ever pay you is either what you paid them in the last 6 months or €100, whichever is higher. For free tier users, that's just €100 maximum—even if the damage was much larger.

Two-month notice required for data portability
📌Other💬 If you want to take your data and move to a competitor, you need to give Anthropic two months' written notice before they'll start the process, and the actual transfer can take an additional 30 days to 7 months.

Data erasure after retrieval period
🗄️Data retention💬 After you leave the service and retrieve your data, Anthropic will delete your data—but they can still keep it if other laws allow them to, which is a potentially broad exception.

Services can be changed or discontinued
📝Can change terms anytime💬 Anthropic can change, reduce, or completely shut down their services. They'll try to give 30 days' notice for major changes, but in urgent situations they can act immediately without warning.

Immediate suspension without notice for breaches

Inactive accounts can be terminated

📌Other💬 You can't transfer your account to someone else, but Anthropic can sell or transfer the entire business—including your data and account—to another company without asking your permission.

Data may be deleted upon termination
📌Other💬 When your account is terminated for any reason, Anthropic can delete all your data and conversation history at their discretion, potentially without giving you time to retrieve it.
“Upon termination of these Terms, a Subscription, or your access to the Services, the rights granted to you under our Terms (or any Subscription) to access and use our Services will immediately terminate, and we may at our option delete any Materials or other data associated with your account.”
Right to report to law enforcement
📌Other💬 Anthropic can share your conversations and information with law enforcement at their own discretion, without necessarily needing a court order or warrant.

Irish law governs
📍Jurisdiction💬 Any legal disputes are governed by Irish law and must be filed in Irish courts, though EEA/Swiss consumers can also use their local courts. This could make it expensive and difficult for non-European users to pursue legal claims.
“These Terms are governed by Irish law. This means that your access to and use of our Services, and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims) will be governed by Irish law, and must be brought in a competent court in Ireland.”
Note: Users can opt out of AI training via account settings (though exceptions apply for Feedback and safety reviews). Users have data switching and portability rights under Section 12 with formal notice periods. Users have a 14-day cancellation right. Users can close their account at any time. Statutory rights are preserved.
